Robert Rhodes Prevails in Slip and Fall Near Dinner Buffet

FLB Law Partner Robert Rhodes prevailed in a case involving a patron who slipped and fell on a tomato near the food buffet in a lounge at a hotel. The plaintiff claimed the injury from the fall to his shoulder and knee prevented him from working in the pizza restaurant he owned, and as a result, he was seeking a demand in excess of $500,000.

 At trial, Bob argued that there was no evidence of how long the tomato was there or how it got there and that the most reasonable inference was that the tomato parts had not been on the floor for an amount of time that would have allowed for its discovery and remediation. The court agreed and found in favor of the defense.
