FLB Law Settles Lease Dispute for a Fraction of the Seven-Figure Demand

FLB Law attorneys Eric Bernheim and Brian Tims successfully resolved a real estate lease dispute on behalf of a sublessor client, who paid only a small fraction of the million-plus dollars sought by the landlord. The landlord claimed that it was owed significant back rent arising out of a failure to pay rent by our client’s sublessee.   FLB Law’s client ended up caught in the middle and faced significant exposure under a guarantee agreement.

In this triangular scenario, the landlord filed a case against our client for back rent, while our client filed two actions against the sublessee for eviction and back rent. Our attorneys evaluated the risk to our client and recommended offering the landlord a best and final settlement offer to avoid costly litigation. The worst-case scenario would be that the offer would be rejected, and we would have to litigate.

Eric and Brian worked with our client to come up with a fair resolution. Our client made a good-faith offer, which sparked negotiations. This resulted in a global resolution among the three parties, where all actions were dropped, and the dispute was settled favorably and quickly without significant litigation or expense.
