FLB Law Secures Variances for a Hotly Contested Residential Redevelopment Project in Westport, CT

FLB Law’s Zoning & Land Use attorney Rick Costantini obtained four variances for a residential redevelopment project at 215 Hillspoint Road in Westport, CT.  The variances addressed the need for two setbacks, the amount of building coverage, and how the property impacts the sightline at the traffic light on the corner of Old Mill Road and Hillspoint Road.

Securing the variances was especially difficult given the odd configuration of the narrow corner lot, but without them, the owner would not be able to build a house bigger than the 1400-square-foot one that currently sits on the property, where they have lived for 30 years. The proposed redevelopment includes additional greenery, a driveway with a turnaround and a 1,800-square-foot house.

 While FLB Law had to submit two different plans before the board approved it, he was able to get the four variances needed to move forward. This project, however, is hotly contested by one of its neighbors, who filed a lawsuit against the town, its Zoning Board of Appeals and the Hillspoint Road homeowner over the Zoning Board’s approval of the plans to reconstruct the house. The case is currently pending.
