Our team of litigation attorneys include Thomas Lambert, Stephen Fogerty, Robert Rhodes, Joshua Auxier, Brian Tims, and Matthias Sportini, and they receive exceptional support from Kim Koorse, Christina Bennett, and Sue Hermann. The team assesses each case to establish potential exposure, determining the optimal path to resolution: settlement, motions practice, mediation, or trial. In addition to being admitted in state and federal court, our attorneys are admitted to practice in the Mohegan Gaming Disputes Trial Court and the Mohegan Gaming Disputes Court of Appeals.

The litigation team also provides risk management and pre-litigation counsel to all clients in an effort to avoid future litigation. For example, Joshua has recently been fielding calls from condominium associations about condo amenities.
“As we start to move into this gray area between full-on Pandemic and the State/Country re-opening, some condos are taking a cautious view and do not want to open their common facilities,” Joshua said. “At the same time, their fully vaccinated members are upset that re-opening is not going as fast as they want.”
